By The Canadian Press Thu., Feb. 14, 2019 OTTAWA—The Supreme Court of Canada says an Ontario high school teacher who used a pen camera to surreptitiously take videos of female students is guilty of voyeurism. Teacher Ryan Jarvis was charged with voyeurism after discovery of more than two dozen videos on his pen, many of which focused on the chests and cleavage area of students at the London, Ont., school. Jarvis was acquitted when the trial judge found that while the students had a reasonable expectation of privacy, it was not clear the videos were taken for a sexual purpose. The Ontario Court of Appeal dismissed the Crown’s challenge of the ruling, although for different reasons. A majority of the appeal court concluded the videos were made for a sexual purpose, but said the students should not have an expectation of privacy in the school setting. A Silicon Valley billionaire is fighting to keep a beloved beach near his $37 million estate off-limits to the public — and he’s taking his case to the Supreme Court

caption Vinod Khosla wants his public beach back. source TechCrunch / Flickr The battle between tech titan Vinod Khosla and California activists is heating up. This week, Khosla filed an appeal with the US Supreme Court to overturn a 2017 ruling that forced him to open public access to a California beach that surrounds his shorefront property. In 2008, Khosla – who made his fortune as an investor and one of the co-founders of Sun Microsystems – paid a reported $37 million for an 89-acre parcel near Half Moon Bay, about an hour south of San Francisco. For many decades, surfers and families had enjoyed the beach, which is known for its stunning geological formations, picnic areas, and ideal surfing waves. When Khosla closed the gate to Martins Beach in 2010, locals revolted. A California appeals court later ruled that Khosla violated state law when he blocked the public from accessing the beach and forced him to reopen it. Now … [Read more...] about A Silicon Valley billionaire is fighting to keep a beloved beach near his $37 million estate off-limits to the public — and he’s taking his case to the Supreme Court

The Supreme Court (SC) has formally issued a gag order to camps of former senator Ferdinand Marcos Jr. and Vice President Maria Leonor Robredo in connection with an electoral protest filed by Marcos against Robredo. In a resolution, the SC en banc, sitting as Presidential Electoral Tribunal (PET), ruled that since a revision of the electoral protest is about to start, strict compliance with the sub judice rule must be observed. “Considering that the revision process is about to commence, the tribunal directs both protestant and protestee to observe the sub judice rule,” it stated. The ruling was dated February 13, 2018 and was signed and promulgated by Felipa Anama, Clerk of the Supreme Court. The Manila Times earlier was able to publish the gag order that it had obtained from its sources in the High Court. Allegedly massive cheating committed during the May 2016 elections was bared by Marcos through evidence discovered to favor Robredo. Supreme Court 2008 decision: Boracay is state property

February 21, 2018 robert Leave a Comment

RIGOBERTO D. TIGLAO But Aquino 3rd ignored it, as well as Arroyo’s Proclamation 1064 It is the state which has ownership of this once paradisiacal island. It therefore may decide what to do with it, close it down or take it over. Boracay again is a classic case of a weak Philippine state losing control of land it is the supreme sovereign of, and allowing it to be ravaged both by uncaring local and foreign capitalists. Although scandalously ignored to this day, the 15-member Supreme Court under then Chief Justice Renato Puno unanimously ruled in October 2008 (G.R. No. 167707) that there is no legal basis for private individuals to claim ownership of any property in the island. (To his credit, even Justice Antonio Tirol Carpio, a member of the Tirol clan that is the biggest single landowner in the island concurred with the decision written by Associate Justice Ruben Reyes.) There hasn’t even been  a move to ask the court to reconsider its decision. Many of the big … [Read more...] about Supreme Court 2008 decision: Boracay is state property
